Dan Walters: California needs more than Proposition 31 to fix what ails it

California's chronic budget deficits ? even in times of economic expansion ? testify to its political dysfunction, which is reason to wonder whether a November ballot measure on budget procedures, if enacted, would have much positive effect.

California Forward, a centrist amalgam of civic, political and cultural elites, has proposed what is now Proposition 31 (the numbering sequence is subject to a pending lawsuit). It includes such changes as more public notice on legislation, two-year budgeting cycles and requiring any major new spending program or tax cut to identify an offsetting revenue or savings.

Political activists on the left and right dislike Proposition 31's provisions, which might be a good reason for others to embrace them. But the real question is whether they would truly move California closer to fixing its finances, or merely add another layer of complexity to the Capitol's already byzantine fiscal games.

The history of dictating budget procedures via ballot measure is not encouraging.

More often than not, governors and legislators wind up putting together a political deal to do what they want to do and then dreaming up ways to make it legal, or at least legal enough to get them through another budget cycle.

Take, for instance, Proposition 98, the 1988 constitutional amendment on school finance that only a handful of fiscal mavens profess to understand, and rarely agree on what it means.

When Proposition 98 requires the state to spend more on schools than it has to spend, or more than politicians want to spend vis-?-vis other categories, they employ bookkeeping tricks to give the schools money on paper, but not in cold cash.

Routinely, the Capitol's denizens dream up phantom revenue and ignore spending obligations to produce budgets that are "balanced" on paper but have immense real-world gaps.

So why wouldn't they just ignore or work around Proposition 31? Most certainly they would, if the politics of the moment impelled them to do so.

The budget mess ? along with other long-simmering, never-resolved issues such as water, transportation and education ? is just a symptom.

California's budget process is dysfunctional because its politics are dysfunctional. They are dysfunctional because an archaic structure does not and cannot reconcile the conflicting demands of a very large and very complex society.

California needs a top- to-bottom overhaul that connects political decision-making to its unique social and economic reality and creates cause-and-effect accountability for those we elect to office.

Proposition 31 is akin to giving someone with a flesh-eating infection an aspirin to relieve the pain momentarily when the patient truly needs radical surgery or powerful drugs to stop the infection.

A team of researchers from the Wildlife Conservation Society (WCS) and the National Research Council of Argentina recently fitted a South American sea bird called an imperial cormorant with a small camera, then watched stunned as it became "superbird" diving 150 feet underwater in 40 seconds, feeding on the ocean floor for 80 seconds where it eventually caught a snakelike fish, before returning to the surface 40 seconds later.

This is the first time researchers have been able to watch first-hand the amazing feeding techniques of these fascinating birds, which occur off the coast of Argentina.

The footage shows the cormorant briefly on the surface before diving for the bottom. The camera is attached to the bird's back, so the view is of its head as it pumps its feet to swim deeper. When it finally reaches the ocean floor, it explores a vast area searching for food. It eventually finds an elongated fish, which it brings to the surface to eat.

The footage came from Punta Len in Patagonia, Argentina, a coastal protected area supporting more than 3.500 pairs of imperial cormorants. A WCS scientific team, led by Dr. Flavio Quintana, has been studying the cormorants' feeding behavior for the past ten years. The team was joined by Dr. Carlos Zavalaga along with Ken Yoda from the University of Nogoya, Japan to fit the camera on the bird.

The WCS team has tracked more than 400 cormorants along the Patagonian Coast of Argentina using cutting edge technological tools such as multi-channel archival tags and high resolution GPS-loggers. This information will help identify priority feeding areas to help design new protected areas and to understand environmental conditions that affect cormorant populations.

What Fraction of Bankruptcies Is Caused By Medical Debt?

We don?t have to look very far for an answer. It seems that the authors are reluctant to take their respondents seriously when it comes to an understanding of their indebtedness. The survey clearly states that only 29 percent of the respondents believed that their bankruptcy was actually caused by medical bills. This number sounds like a reasonable approximation of the actual impact of medical debt on bankruptcies. In fact, it accords well with other findings in the literature, including my own. In an AEI working paper, I showed that when medical debts (as a fraction of income) rise by 10 percent, we are likely to observe an increase in bankruptcy filings induced by those debts by approximately 27 percent. In other words, if between 2001 and 2007, medical debts increased by about 10 percent (as a fraction of income), the study suggests that about 27 percent of the total filings during this period can be attributed to medical debts. The SCF shows that for all families, total debts as a fraction of income actually have increased by roughly that 10 percent figure over this period. Therefore, even if all of this increase was due to medical debts (which is unlikely since mortgage debts are ten times higher), the additional bankruptcy filings due to medical debts should be 27 percent of the total. Another paper by Domowitz and Sartain estimates the fraction of medical bankruptcies at about 30 percent, half of what the Warren study finds.

America's failing grade on cyber attack readiness

The man in charge of America's cyber operations said that on a scale of one to 10, the nation's preparedness to deal with a major cyber attack on critical infrastructure sits at a dismal three.

"Somebody who finds vulnerability in our infrastructure could cause tremendous problems," Army Gen. Keith Alexander, Director of the National Security Agency and chief of U.S. Cyber Command, told audience members at the Aspen Institute's annual security forum late Thursday, according to multiple reports. Alexander said that since 2009, attempted cyber attacks on the nation's infrastructure systems have risen seventeen-fold.

"I'm worried most about power. I'm worried about water. I think those are the ones that need the most help," he said.

Top current and former U.S. security officials have for years been decrying vulnerabilities in the computer networks of critical infrastructure industries from water treatment centers to electric power plants -- largely facilities owned and operated by private entities. In his remarks, Alexander reportedly pushed for greater role of government, specifically the Department of Homeland Security, in regulating security measures across industries.

Two years ago, computer experts discovered Stuxnet, a cyber weapon of unprecedented power and complexity that was apparently designed to damage an Iranian nuclear facility. The worm had demonstrated what computer experts had long though possible but had never actually seen: computer code that was no longer confined to disrupting computer systems internally but could reach out and physically alter how a facility works, or potentially destroy it.

Before the worm was alleged to have been a creation of a joint U.S.-Israeli cyber operation, other U.S. officials quickly realized that such a powerful cyber tool may be turned on the homeland. In a Senate Homeland Security committee hearing in November 2010, committee chairman Joe Lieberman (D.-Connecticut) warned the worm could be used as a "blueprint" for other "malicious hackers."

Richard Clarke, former White House counterterrorism advisor, cyber security expert and ABC News consultant, said in January that since Stuxnet was a "plug-and-play" worm, other hackers or foreign governments could take it, modify it and turn it against the U.S.

"You can take out certain components and put in others and you have a very powerful weapon that could be used against the electric power grid or any other system that has computers telling machines what to do," he said. "The best cyber weapon in the world has been spread around for other people to have copies of? I think it's very likely that somebody could do this."

Months later, the Department of Homeland Security revealed that the original Stuxnet worm did manage to infiltrate a computer system in the U.S., but since it was only tailored to hit the Iranian nuclear facility, it didn't do any known damage to the American facility.

Sean McGurk, a former DHS official who is now senior policy officer at the Industrial Controls Systems Information Sharing and Analysis Center, told a radio show in early June that he had already seen hackers modifying Stuxnet for their own uses. He also noted that as one of the most computer-reliant nations on the planet, the U.S. is also one of the most vulnerable.

"Because everything from elevators to prison doors are controlled by computers in our country, these systems lend themselves to manipulation and potentially to destruction," he said.

Since Stuxnet's discovery, cyber experts have found two other highly-sophisticated cyber weapons: Duqu, a cyber program built in the style of Stuxnet but for espionage rather than offensive operations, and Flame, the largest espionage program in history designed to capture any keystroke, image and conversation even near the infected system. Based on stunning similarities in the code of all three programs, researchers said they believe they were all created by either the same team, or at least teams of computer experts with access to each other's original work.

And in less than a month, just about any of those 600 million supporters will be able to make one call or a simple click of the mouse and own shares of the iconic franchise. Buying shares of Man United will be a great idea to many for the obvious personal reasons but the real question is whether or not buying shares of Manchester United is a good investment at all?

Why is Manchester United Going to Be Listed on the New York Stock Exchange?

So let?s analyze why a famous British Soccer team is going to list and trade at the New York Stock Exchange. It starts with a rich owner, Malcolm Glazer, who has huge ambitions and aspirations for the club. Malcolm Glazer bought the team in 2005 for $1.2 billion and wants to go public, raise funds, and mitigate risks while still retaining control of the team. Something every investor would love to have the opportunity to do. Listing on the NYSE will give the Glazer family a dual-class share structure; allowing them to keep voting rights.? This model is very much similar to the structure the Murdoch family setup to keep control of News Corp (NASDAQ: NWSA). Listing on the London Stock Exchange would not allow this kind of setup which is why they have chosen to bring the British Soccer across the pond.

What Can We Expect as an Investment?

What?s not to like, Manchester United is a franchise that turns a profit every year and has a track record of being a solid equity investment. Man United has appreciated more than ?20%?annually for the 14 years it was traded prior to the Glazer family taking control and taking it private seven years ago.

Cash is king & Manchester United has serious debt woes. The lopsided stock-ownership structure is nothing to be worried of when you compare it to the franchise?s debt woes. Yes that?s right, Man United currently has $650 million in debt, a staggering number when you factor in that the club carried no debt every year before 2005 when the Glazer family gained ownership. Since then, the Glazer has leveraged the club quite a bit using these tactics to get the team, and since the acquisition have used it as a piggy bank of sorts.?

If the IPO is successful and raises the expected $300 million or more where will that money go? Being valued at $3 billion, the assumption is that most of that money will pay down the debt but some fans or future shareholders might have other plans. Fans hope the money raised goes towards some more exciting business moves such as acquiring top notch players to keep up with the rest of the league, lowering ticket prices, or improving the stadium grounds. Acquiring top talent is even more intense now after they lost to cross-town rival Manchester City, a team that was long one of the worst in the league until it was purchased by a group from Abu Dhabi who invested billions in acquiring the top players across the world and successfully turned the team into an instant winner.

Manchester United fans have been pressuring the club more and more to acquire top players but the club?s debt worries have sucked out hundreds of millions that the team use to use to improve the talent on the pitch. A main reason Manchester United isn?t the football powerhouse that use to dominate the league year in year out.

For sale: world-famous company that?s highly leveraged with anti-takeover provisions and no dividend or stock buyback plans in sight.

A large issue surrounding the IPO is future accountability. As result of the Jobs Act, foreigncompanies can take advantage of many loopholes. For example, Manchester United will not have to report results every quarter or give forward-looking guidance. Pretty sweet deal for ownership, but a serious issue for most investors.

Who wants to own shares of a company saddled with debt where even the largest shareholders hold no control. Many will still buy for the same reason people bought shares in the Green Bay Packers, a stock that is such a novelty that shares have no dividend and cannot be sold for a profit. There will be a large group of wealthy fans who love the team and want the power to say they own part of Man United. But that doesn?t mean they?ll make any money off it. So to investors, especially institutional ones it could be a tough sell. One thing Man United does have going for them is the fact that they?re an exclusive rarity that compares to nothing. Just think you could own a piece of Manchester United, the most glorified football team. For most diehard fans that?ll be an easy sell.

What other Sports Teams are Publicly Traded? While there are technically no other professional sports teams publicly traded in the U.S., investors can buy shares of Madison Square Garden (NASDAQ: MSG), which gives you ownership of the NBA?s New York Knicks, the NHL Rangers, a WNBA team, an arena and a TV network. Sorry, no Jeremy Lin though. Another similar company is Liberty Media (NASDAQ: LMCA) owns the Atlanta Braces baseball team, which is only one component of their huge portfolio of companies. Nintendo (NTDOY) owns most of the Seattle Mariners, Rogers Communications (RCI) a small piece of the Toronto Blue Jays. So technically all of these are indirect ways to owning a sports team. Outside the U.S., there are a handful of soccer teams that actively trade on other foreign global markets. For example, AJAX trades in the Netherlands; Juventus in Italy; Benfica in Portugal, and Fenerbache a lesser-known name listed in Turkey, but has an annualized return of almost 14 percent. Meanwhile the other mentioned teams all had negative annualized returns and have all been losing investments. The big question looming is where Manchester United will stand.

When will it be on the market? The worldwide roadshow is just beginning and Manchester United has elaborate plans to host a worldwide road show that will start in Europe and end in the U.S.? Pricing and trading is expected to begin at some point in August but due to recent reports of the IPO being a tough sale Manchester United has put the IPO on hold. While it?s technically on hold, things could change very soon as analysts expect the roadshow will start next week, speeding up the process in hopes to feed off of the U.S. markets big recent rally. That?s right around the time that Manchester United kicks off its regular season. Only time will tell on which will be the bigger winner, the team on the field or the team on the stock exchange.?

(AP) ? NBC's Bob Costas noted a controversy over honoring Israeli athletes killed at the Olympics 40 years ago during his coverage of the opening ceremony but stopped short of offering his own protest.

The International Olympic Committee had declined a request to hold a moment of silence during the ceremony to acknowledge the 11 Israeli athletes and coaches killed by Palestinian gunmen in Munich in 1972. Costas called that decision insensitive during an interview this month and indicated he would call for his own moment of silence when Israeli athletes marched into the Olympic Stadium on Friday.

Costas' comments took his bosses by surprise. Jim Bell, executive producer of the NBC's telecast, said this week that Costas hadn't brought it up with him before the interview.

As the athletes marched in Friday, Costas said that IOC President Jacques Rogge led a moment of silence for the late Israelis this week before about 100 people at the Athlete's Village.

"Still, for many, tonight with the world watching is the true time and place to remember those who were lost and how and why they died," Costas said.

After a five-second pause, NBC cut to a commercial.

Abraham Foxman, national director of the Anti-Defamation League, which promotes Jewish causes, said he appreciated Costas bringing up the issue, though he didn't expect a moment of silence.

"He established a sense of history and decency and sensitivity, I would say, in the tradition of Jim McKay," Foxman said. The late McKay is the former ABC sportscaster who anchored coverage of the 1972 attack.

Apple wins stay on having to post 'Samsung did not copy' notice

Apple's pride can stay intact for at least a little while longer: the company successfully won a stay on a UK ruling that would have it post notices clearing Samsung's name in the wake of the two tech giants' patent dispute in the country. Apple now won't have to face any kind of public flogging unless it loses an appeal on the non-infringement verdict, which is due to be heard in October. Not surprisingly, the iPad creator doesn't want its own site to become a billboard promoting someone else's work. The decision makes Samsung's victory that much more bittersweet -- along with losing that instant satisfaction from a humbled Apple, it still has to accept a verdict that claims the Galaxy Tab supposedly isn't cool enough to have been an imitation.

Ancient Poop Gives Clues to Modern Diabetes Epidemic

The ancient Native Americans of the desert Southwest subsisted on a fiber-filled diet of prickly pear, yucca and flour ground from plant seeds, finds a new analysis of fossilized feces that may explain why modern Native Americans are so susceptible to Type II diabetes.

Thousands of years of incredibly fibrous foods, 20 to 30 times more fibrous than today's typical diet, with low impact on the blood sugar likely left this group vulnerable to the illness when richer Anglo foods made their way to North America, said study researcher Karl Reinhard, a professor of forensic sciences at the University of Nebraska-Lincoln.?

"When we look at Native American dietary change within the 20th century, the more ancient traditions disappeared." Reinhard told LiveScience. "They were introduced to a whole new spectrum of foods like fry-bread, which has got a super-high glycemic index."

The glycemic index of a food is a measure of how fast its energy is absorbed into the bloodstream. It's measured on a scale of 1 to 100, with 1 being the slowest absorbing with the least effect on blood sugar. The native people who lived in the deserts of Arizona would have likely eaten traditional stews with glycemic indexes around 23, Reinhard found. Modern food and modern disease

Members of Southwest Native American tribes are more susceptible than Caucasians to Type II diabetes, which happens when the body either doesn't produce enough insulin to break down sugar from food, or when the body's cells fail to recognize the insulin it does produce.

Researchers have long hypothesized that a "thrifty gene" (or, more likely, genes) acquired through feast and famine makes Native American populations more prone to this chronic disease. The idea is that people who were able to rapidly adapt to both lean times and times of plenty would have done better in ancient times. Today, the modern diet has rendered famine rare in the developed world, but the body continues to respond to times of plenty as if starvation is around the corner. Diabetes and obesity can result.?

Reinhard and his colleagues now suggest that feast and famine may not be necessary for the "thrifty gene" hypothesis to make sense. Basically, Reinhard said, an extremely low-calorie, high-fiber diet made the ancient Native American gut a paragon of efficiency. With the arrival of whites, the diet changed faster than physiology could keep up with it. In other words, the digestive system didn't evolve for abundant, high-GI foods.?

High-fiber diet

To find solid evidence of what ancient Southwestern tribes actually ate, Reinhard turned to what he called "the most intimate residues from archaeological sites" ? fossilized poop. Known as coprolites, these fossils contain a record of their creator's most recent meals.

The researchers analyzed 25 coprolites from Antelope Cave in northwestern Arizona, a dwelling that was seasonally occupied for thousands of years. These particular coprolites (20 of which turned out to be human) date back to at least A.D. 1150 and earlier. The dates make the cave a perfect time to look at the transition from a total hunter-gatherer lifestyle to one supplemented by some agriculture, Reinhard said.

"It bridges two different dietary traditions, one which has been around for several thousands of years with one that was relatively newly introduced at the time the cave was occupied," he said.

The analysis revealed that these ancient people chowed down on flour made from maize and wild sunflower and other seeds, as well as on fibrous succulent plants such as yucca and prickly pear. This diet was higher fiber than anything modern people eat. The feces were three-quarters fiber by volume, Reinhard said, and these Native Americans were probably eating between 200 and 400 grams of the indigestible stuff per day. For comparison, the Institute of Medicine recommends 25 grams of fiber a day for the modern woman, and 38 grams for men. The average adult manages only about 15 grams. Modern agriculture has favored plants with less fiber, Reinhard said, so even the ancient tribes' maize would have been more fibrous than the corn we eat today.

"When I was a young researcher I tried to replicate this diet, and it was impossible," Reinhard said. "I was essentially eating all day to try to get this fiber."

Evolving diets

In addition, Reinhard and his colleagues reported in the August issue of the journal Current Anthropology, the Southwest Native American diet had a very low glycemic index. Prickly pear pads, a common staple, rate only a 7 on the 100-point GI scale. The highest-GI food these tribes would have had was maize, the researchers found, which would fall at about 57 on the scale ? just two points shy of qualifying as a "low-GI" food today. (Modern sweet corn on the cob has a GI of 60; processed foods like white rice and bagels are in the 90-95 range.)

In addition, prickly pear has a known blood-sugar-lowering effect, Reinhard said. Agave and yucca plants would have also had minimal effect on the blood sugar while providing yet more fiber. Rabbit, including bone fragments, was also found in the fecal fossils.

"The change we have undergone over generations has been toward less appreciation of really resistant foods and more toward what is called a 'Pablum' diet," Reinhard said. "It's kind of like going from chewing on pumpkin seeds to chewing on oatmeal."

The diet seen in the desert Southwest up to just 1,000 years ago is likely similar to what people ate the whole world over up until about 15,000 years ago, Reinhard said. And then humans invented agriculture, cultivating wheat, millet, rice and other grains.

"These plants, as they were cultivated, replaced the really, really ancient foods that everybody ate thousands and thousands of years ago with calorie-dense foods, or grains that could be turned into calorie-dense foods like grains, rice cakes, and, of course, alcoholic beverages," Reinhard said.

David McCandless, a data journalist and author of The Visual Miscellaneum presented a talk at information super conference?TED on the topic of data visualization, stating:

?By visualizing information, we turn it into a landscape that you can explore with your eyes, a sort of information map. And when you?re lost in information, an information map is kind of useful,? says McCandless.

Students earning their Graphic Design degree at FIDM/Fashion Institute of Design & Merchandising, got the opportunity to tackle their own infographic project last quarter.

Design II Instructor Kyle Chan at FIDM San Francisco challenged his students to select a topic of their choice and illustrate information about their topic using their own illustrations.

Inspired by McCandless? speech, below are the infographics designed by FIDM Graphic Design Students Caroline Qvale, Gavin Rochford, Heezu Jun and Erin Opperman.

So what did we learn?

Apparently, Cheerios still reigns as the supreme cereal of choice; that shoe size does matter when it comes to an NBA player?s career; that Xbox360?s worldwide sales are surprisingly low compared to its Playstation and Nintendo counterparts; and that Washington is the most likely state to spot Bigfoot.

Channing Tatum: Open to Fifty Shades of Grey Role! Sort Of!

Tatum is married to actress Jenna Dewan. But she might need to get in line behind Emma Watson, who is reportedly a leading candidate for the character of Anastasia Steele.

Other actors that have expressed interest in portraying Christian include Ian Somerhalder, Ryan Gosling, and Alexander Skarsgard.
