After my first post on ?10 Leasing Tips Every New Business and Startup Should Know?, I had a conversation with the Controller of a company about making an earnest money payment for a proposed equipment lease for his business. I realized I hadn?t really properly covered this topic in my last post.? There are some pitfalls to avoid, so here are 7 things every business needs to know about earnest money payments in lease transactions.

An earnest money payment is sometimes required by an equipment financing company (lessor) from a lessee equal to a fixed amount or one month?s rent as a refundable application fee. The earnest money payment can be called an application fee, deposit, due diligence fee, etc.
On receipt of a signed lease proposal and the earnest money payment, the financing company (lessor) works with the lessee to gather all the required and requested financial and equipment information, writes an internal credit request memorandum, and submits the lease transaction to the credit department for approval.? This information is submitted along with the signed lease proposal, the payment, and any application fee.
Some financing companies (lessors) require the earnest money payment as security to ensure its processing costs are covered if the lessee decides not to proceed with the agreed lease (No one likes to do a ton of work for free).
Not all financing companies require an earnest money payment or application fee in every case.
If the lessor approves the lease transaction, the earnest money payment is applied to the first or last rental payment due under the lease. If the lessor declines the lease transaction, the earnest money payment is refunded.
In addition, if specifically agreed in the lease proposal, regardless of whether a lease is approved or declined, a small portion of the earnest payment will be retained as an application or processing fee.
It is easy to negotiate a reasonable earnest money payment. Read the lease proposal and don?t sign until you understand what you are agreeing to.

CARACAS, Venezuela (AP) ? President Hugo Chavez arrived in Cuba for urgent cancer surgery following an emotional departure from Venezuela in which he vowed to win October's election despite his illness.

The socialist leader said he was greeted at the airport by President Raul Castro and that he planned to meet with Cuban doctors for medical tests on Saturday.

"I have faith that everything will go well," Chavez told Venezuelan state television by telephone late Friday. He said he brought with him a box of books to read to pass the time.

Before departing for Havana, Chavez addressed allies and soldiers in a speech filled with references to Jesus Christ and South American independence hero Simon Bolivar.

"Our (founding) father Simon Bolivar once said, 'I am a man of troubles.' I say as a son of Bolivar, I too am a man of troubles. We are a people of troubles," Chavez said. "Let the troubles come and add like the cross of Christ to the definitive liberation of the country. With the cross of Christ, one must sometimes bear pain as a spur to love. It is fuel for love."

Chavez, who is seeking his fourth term as president, has said the tumor that doctors will try to remove is probably malignant.

"I say this from my gut: With cancer or without cancer ... come rain, thunder or lightning ... nobody can avoid a great patriotic victory Oct. 7," the president said. "Long live Chavez!"

Chavez, 57, is turning to the same Cuban doctors who extracted a baseball-size cancerous tumor from his pelvic region last summer. This time, the growth is smaller, about an inch (two centimeters) in diameter.

Cuba and Venezuela are staunch allies, and Chavez enjoys a warm relationship with former leader Fidel Castro and his brother Raul.

The Venezuelan president has not disclosed the precise location of either tumor, nor said what kind of cancer he had, but described next week's surgery as urgent.

Cuban health care is generally considered good, but oncology experts not involved with Chavez's care say he could be taking a risk by skipping more respected facilities in the United States, Europe or Brazil ? which has Latin America's most advanced cancer centers with specialized radiation equipment.

"If you have a 'common' cancer, that of the breast, colon or lung ... then it's going to be easy to find standards of care that are the same in the U.S., Brazil or Cuba," said Dr. Julian Molina, an oncologist at the Mayo Clinic in Rochester, Minnesota. "The problem comes when you have a tumor that's not one of the common ones, and that's what most of us suspect Chavez has."

National Assembly President Diosdado Cabello, a retired army lieutenant who accompanied Chavez in his failed 1992 coup, said Friday that the Venezuelan opposition should be the most worried about the president's survival.

"The people in the street will not retreat a single millimeter, not a single millimeter, from what has been accomplished in these 13 years" since Chavez took office, Cabello said.

Chavez allies have accused their political foes of hoping the president will die, opening a door for the opposition to win the Oct. 7 vote.

Rival candidate Henrique Capriles has rejected such allegations and said he wishes for a Chavez recovery so Capriles can triumph "fair and square."

As Chavez's motorcade traveled through the streets of Caracas, hundreds of supporters covered his SUV with flowers and even a portrait of Jesus that read: "I will heal you. Forward, commander!"

"This goodbye should encourage him. I hope he returns and knows we love him," said Lucia Cabeza, an unemployed 24-year-old.

For others, it was just the latest spectacle surrounding a man with a confirmed flair for the theatric. He was given a similar send-off last summer when he flew to Cuba for treatment.

"It was a terrible exaggeration. They took him here, they took him there," said Fatima Abreu, a 47-year food vendor. "It's not the first time he's leaving, nor the first time he's having surgery. Even for his own health, he should be taking it easy."

"Chavez has been doing this for 13 years," added Margarita de Rodriguez, a 55-year-old homemaker. "Recently they celebrated the 4th of February, the coup that failed, and now they're making a circus of his illness. They always do everything thinking about the elections."

Chavez plans to continue governing from Cuba instead of delegating authority temporarily to Vice President Elias Jaua. He has not said when he might return to Venezuela.

Trooper Tony Radulescu was shot and killed while making a traffic stop on State Route 16 at Anderson Hill Road, in Gorst, shortly before 1:00 am.

He had radioed in his location and the pickup truck?s license plate and description to dispatchers. When dispatchers were unable to contact him for several minutes a Kitsap County sheriff?s deputy was sent to check on his status and discovered him laying wounded outside of his patrol car. He was transported to St. Joseph Medical Center in Tacoma where he succumbed to his wounds a short time later.

The vehicle that Trooper Radulescu had stopped was found abandoned on a country road approximately three hours later. A SWAT team deployed to the registered owner?s home and as they approached it the suspect committed suicide.

The trooper was shot and killed in an early morning traffic stop of a green truck? in the Kitsap County town of Gorst.?The trooper has been identified as Tony Radulescu, 44, a 16-year veteran of the agency.

Police were approaching the suspect?s house on Southeast Scofield Road in a secluded, heavily wooded, rural area of Port Orchard when they heard a single gunshot.?? The man found inside, identified as Josh Blake, was transported to Tacoma General Hospital.

Trooper Radulescu was a military veteran and had served with the Washington State Patrol for 16 years.

MOSCOW (AP) ? Prime Minister Vladimir Putin warned against the dangers of foreign influence on Thursday at a campaign rally attended by tens of thousands of people, many of them state workers who were pressured to take part as a show of support for a leader facing his first outburst of public discontent.

With little real competition, Putin is almost certain to win a third term as president in the March 4 election. During 12 years in power, he has sidelined his political opponents and portrayed himself as the defender of a strong and prosperous Russia. His approval ratings are still running at well above 50 percent despite the largest opposition protests the country has seen since the 1991 Soviet collapse.

Putin has tried to discredit the protesters by accusing their leaders of being paid agents of the United States working to weaken Russia. His references on Thursday were slightly more subtle as he called on all Russians who "cherish, care about and believe in" their motherland to unite.

"We ask everyone not to look abroad, not to run to the other side and not to deceive your motherland, but to join us," he said from a makeshift stage in a soccer stadium as a light snow fell on his bare head.

But he also warned the West: "We won't allow anyone to meddle in our affairs or impose their will upon us, because we have a will of our own."

The pro-Putin rally was held on Defenders of the Fatherland, a national holiday that replaced the Soviet-era Red Army Day. As participants marched in columns toward the stadium along the Moscow River, they carried Russian flags and wore armbands in the national colors. Patriotic songs from decades past blared from vans parked along the route.

They carried signs saying "As long as we have Putin we have a strong country."

The rally was a response to the opposition protests, which began in December after a parliamentary election that Putin's party won through what appeared to be widespread fraud.

But while the protests have been embraced by Russia's middle class and young urban professionals, many of those who attended Thursday's rally showed little enthusiasm. They included workers paid by or dependent on the state, including teachers, municipal workers and employees of state companies. Some said they had been promised two days off in return for attending.

Many people at the rally were reluctant to explain why they had come or offered only perfunctory statements in support of Putin. Some were brought by bus or train from other cities around Russia. Thousands bolted for a nearby subway station at the end of the march rather than enter the Luzhniki stadium to hear Putin.

Some march participants, however, offered genuine praise.

"I love Putin and Putin loves me," said Vladimir Gryzlov, a 68-year-old musician who brought his accordion.

With him was 70-year-old Tatyana Goytseva, who said she was too old to live through another change of government.

"We are happy with it, but of course the young people don't think the same," said Goytseva, a social worker who helps the elderly. She said her three grandchildren were not voting for Putin.

Putin has four challengers, including three veteran party leaders who long ago reached an accommodation with the Kremlin and pose little challenge to Putin's authority. The only newcomer is Mikhail Prokhorov, a 46-year-old billionaire businessman who owns the New Jersey Nets basketball team.

Prokhorov's candidacy has been viewed as a Kremlin-approved effort to add legitimacy to the election and channel the discontent of the protesters. Grigory Yavlinsky, the veteran leader of the liberal opposition party Yabloko, was denied the right to run.

Alright guys, I need some good opinions and I need them fast.

A little bit of background - I used to be in love with this girl who I never made a move on, and as a result of it, our relationship fell apart pretty fucking dramatically.

She started dating this guy in California last year (while she was still going to school in Texas), and this year she started attending the same school as him.? I tried to fix my relationship with her sometime in the fall after shitting all over her face over the summer (basically she had been jerking me around for a long time, so I called her out on it, told her I loved her, and said she was a selfish bitch), but obviously, to no avail.

Anyway, about two weeks ago, she accepted the friend request I sent her on facebook several months ago and made up some bullshit excuse for ignoring it.? When I checked her page, it said she was single.

I am not a fucking idiot, and I know she is just trying to have someone mend her broken self esteem - but I still have interest in hooking up with her and definitely wouldn't mind making that happen sometime in the near future.

NOW, this is what I need some advice on.? I have been ignoring her since she decided to contact me again waiting to see if there is anything I can do to make this work in my favor, and I have come up with two possible ideas:

Just keep ignoring the shit out of her until she potentially decides to call me out on it.? If she asks me wtf my problem is, I'll probably just be blunt with her and let her know that if she isn't fucking me then she is a waste of my time.
